Introduction
These Terms and Conditions ("T&C") govern the relationship between [Your Photography Business Name] ("Photographer") and the Client regarding the provision of photography services. Using this website and booking services indicates your acceptance of these T&C.
Definitions
- "Client": The person or entity commissioning photography services.
- "Photographer": Imagen Studios LLC
- "Images": All photographs, digital files, or other visual media created by the Photographer.
Services
- The Photographer provides list of photography services, e.g., portrait, wedding, product photography.
- Specific services will be outlined in a separate booking agreement.
Bookings and Fees
- A non-refundable deposit of $150 is required to secure a session date.
- The remaining balance is due on the day of the shoot, before image delivery.
Cancellation and Rescheduling
- Client cancellations made with more than 14 days' notice will receive a refund of their deposit (minus any incurred expenses).
- The Photographer reserves the right to cancel or reschedule due to illness, equipment failure, extreme weather, or unforeseen circumstances. In case of cancellation by the Photographer, a full refund will be issued.
Image Delivery
- Images will be delivered within 4 weeks of the session date.
- Images will be provided in JPEG format via shared online album.
Copyright and Intellectual Property
- The Photographer retains full copyright of all Images.
- The Client is granted a non-exclusive license to use the Images for outline permitted uses, e.g., personal use, social media sharing, limited commercial purposes.
- The Client may not alter, resell, or claim ownership of the Images.
- The Photographer must be credited when Images are shared publicly.
Liability
- The Photographer's liability is limited to the total amount of fees paid under this agreement.
- The Photographer is not liable for missed photographic opportunities due to circumstances beyond their control.
Dispute Resolution
- Disputes shall be resolved through good faith negotiation. If unsuccessful, these T&C are governed by the laws of the State of New Jersey.
Agreement
By booking a session, the Client acknowledges and agrees to these Terms and Conditions.
